The 5th District Appellate Court has ruled in favor of the City of Effingham in the case involving Village Square Mall.
The case has been in the Appellate Court’s hands since 2024. The former Mall owner, Durga Property Holdings, had filed suit after an auction resulted in the acquisition of the mall by Square Southtown, a group of local developers including Scott Kabbes, Karen Etter and Michael Brummer.
The action by Durga brought any re-development of the mall to a halt. A circuit court case resulted in a ruling in the City’s favor, but Durga then appealed the matter to the Appellate Court and the case has been on hold for months before today’s ruling.
Durga has until mid-June to decide whether to appeal the matter to the Illinois Supreme Court.
We expect a press release from the City on the matter later today.
