After many years, it’s a win for the City of Effingham in the Village Square Mall case, and this one may finalize things.
The Illinois Supreme Court has denied a petition to leave to appeal in the case of City of Effingham vs. Durga Property Holdings. The decision by the high court will issue to the Appellate Court, which had earlier ruled in favor of the City.
The matter went to court after Durga failed to comply with directives by the City and failed to maintain the mall property. Eventually, an auction was held and the property was sold. When that sale failed, the property was awarded to the City.
City officials can now proceed with plans for the facility.
