A Flora man is in custody following an alleged domestic violence incident in Clay County.
The Clay County Sheriff’s Office responded to a 911 hang up just after 4pm Friday at a residence in Harter Township. A short time later the 911 Dispatch Center received another call relating to the same residence stating a male was breaking down the door and yelling.
The responding deputy observed a male subject exit a vehicle and enter the residence when he arrived on scene. The deputy made contact with this subject, who appeared to be intoxicated, from outside the residence and the subject exited the residence. As the deputy attempted to speak with the subject, the subject attempted to reach inside the vehicle, resulting in the deputy restraining him to prevent him from getting into the vehicle. The subject pulled away and began to resist the deputy. The deputy was able to take the subject into custody and secure him in his squad as additional law enforcement arrived on scene. A search of the subject resulted in locating handgun ammunition on the subject.
During the investigation it was reported that there was a physical altercation between the subject and other individuals in the residence. It was also reported at one point the subject was armed with a handgun and discharged rounds outside the residence. Deputies recovered a spent shell casing outside the residence.
As a result of this incident, Nicholas R. Robertson, 39, of Flora, was arrested on counts of Domestic Battery, Reckless Discharge of a Firearm, Interfering with the reporting of Domestic Violence, Resisting or Obstructing a Peace Officer, and Possession of Firearm with No Valid FOID Card. Robertson appeared in Clay County Court on Monday and was denied Pretrial Release at the request of Clay County State’s Attorney Phillip Givens.
