McClure Bill to Pause Increasing Taxes on Those Who Have Died

As the saying goes, only two things are certain...death and taxes.

Legislation is pending in the Illinois General Assembly, though, to make sure that taxes don't continue to accrue on someone who has died.

Local State Senator Steve McClure said charging interest and penalties on property taxes can create significant financial issues for their heirs. McClure's measure, Senate Bill 2832, would allow for the estate of a deceased individual to apply for a waiver with the county treasurer. The waiver would prevent interest and penalties from being charged on delinquent property taxes for the deceased individual. The waiver would apply from the date of the decedent's death until either the estate is closed or the property is sold, transferred or conveyed.

McClure's legislation was inspired by a constituent, Laurie Stall, who had to deal with a similar situation.

The measure passed the Senate this past week and now awaits action in the Illinois House.
