Judge Agrees to Hear Motion to Reconsider Dismissal of Assault Weapons Ban

4th Circuit Chief Judge Douglas Jarman has agreed to reconsider his decision to dismiss a suit filed against the Assault Weapons Ban. 

Accuracy Firearms of Effingham and hundreds of co-plaintiffs had filed suit against the ban, but Jarman dismissed the suit following a similar decision by the Illinois Supreme Court. Greenville attorney Thomas DeVore filed the motion earlier this month asking that Jarman reconsider his decision.

Judge Jarman asked that the plaintiffs file the correct Exhibit to their motion. The defendants are to file their response by October 16, then the plaintiffs are to file their reply by November 6.

The motion will then be set for argument on a date to be scheduled with the Chief Judge's Office.

Suits against the Assault Weapons Ban are still pending in Federal court.
