Judge in White County Grants TRO on Weapons Ban

Judge Scott Webb has granted a Temporary Restraining Order in a case filed in White County Circuit Court that challenges the constitutionality of the state's new weapons ban.

More than 1,000 plaintiffs are a part of the suit. Those plaintiffs include local state representatives Blaine Wilhour and Adam Niemerg and former gubernatorial candidate Darren Bailey.

Judge Webb's ruling is similar to the ruling in Effingham County Circuit Court that was partially upheld in the 5th District Appellate Court.

“This is another win for the Constitution and for honest firearm owners in the State of Illinois,” Niemerg said. “We are chipping away at this extreme law with each case working its way through our court system. It will take time, but this law will be overturned because it is a clear violation of our Constitutional rights.”

Governor Pritzker and Attorney General Kwame Raoul, two of the defendants in the suit, have indicated they plan challenges to the rulings, and Raoul's office said this week it would appeal the appellate court's decision to the Illinois Supreme Court.

“The proponents of this new law have no regard whatsoever for our Second Amendment rights,” Wilhour said. “If the intent really was about crime prevention, we would be focused on stopping violence at its root cause rather than taking legal firearms away from honest citizens. The proponents know this law is unconstitutional. They know it won’t work, but they don’t care because the real intent is to virtue signal to their radical political base.”

As in the Effingham County case, the White County suit only involves those who were plaintiffs in the filing.
