TRO Issued Allowing Three Teutopolis Students to Go to School w/o Wearing Masks

Circuit Judge Douglas Jarman Wednesday issued a temporary restraining order allowing three Teutopolis Unit 50 school students to go to school without wearing masks.

The students are the children of Eric Pals, Jacob and Christina Thompson, and Greg and Rosina Esker. The parents who filed the TRO request are represented by Thomas DeVore of Greenville, who has filed a number of suits across the state in opposition to Executive Orders issued by Governor J.B. Pritzker. 

The order for the TRO, in part, reads that the "plaintiffs have shown there exists a clearly ascertainable right in need of protection, namely that the children, while on school property, are being forced to utilize a device to allegedly prevent the spread of an infectious disease without a lawful order of quarantine being issued against them by the local health department."

The order also reads, "nothing in this order precludes the local health department from issuing a lawful order of quarantine against any or all of the children, which could compel them to utilize a device to prevent the spread of an infectious disease."

The TRO is in force for 30 days from the date it is issued or until 1pm on October 14, when a hearing on a preliminary injunction is scheduled in Effingham County Circuit Court.
