Hearing Completes Proceedings in Landfill 33, Wendt Family Trust Case

A brief hearing Tuesday completed the proceedings in the case involving the Illinois Attorney General’s Office and Landfill 33 and the Wendt Family Trust.

The case involves a release of liquid from the landfill into two waterways that run along the landfill and a resultant fish kill. The incident occurred in 2017.

The settlement involves an $18,000 penalty for Landfill 33. Neighboring landowner Dan Borries has protested the settlement as inadequate. 

The proceedings were supposed to be concluded earlier this year but a legal notice about the proceedings was not correctly published so the hearing had to be re-held. 

IPCB officials said there was no additional information or testimony Tuesday. It’s thought a ruling on whether the IPCB will accept the settlement should come either in late December or perhaps after the first of the year.
