No Final Decision but Some Action in Bailey v Pritzker Suit

The federal magistrate hearing the case involving St. Rep. Darren Bailey and Gov. J.B. Pritzker has not issued a ruling on whether the suit filed by Bailey against Pritzker should be heard in Circuit Court or Federal Court, but he has made a preliminary ruling.

Magistrate Judge Gilbert Sison allowed a response by Bailey's attorney to stand, and gave Pritzker's counsel until Monday to respond.

The response by Bailey's attorney is 11 pages long. The governor's counsel filed an objection, stating that filings in the court in East St. Louis are typically not allowed to be more than three pages in length. 

Once Pritzker's counsel replies to the Bailey counsel's response, the magistrate will decide on where the lawsuit should be heard, either in East St. Louis or in Clay County Circuit Court in Louisville. The lawsuit addresses whether Bailey had to follow Pritzker's stay at home orders past the initial order initiated in March.
