JB Pritzker announced Friday that he is putting a pause on all new state tax incentives for data centers and calling on lawmakers to pass new data center reforms during the fall veto session.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The governor has directed the Illinois Department of Commerce and Economic Opportunity to pause all new agreements starting July 1, fulfilling a proposal he made during his <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/pritzker-proposes-56b-budget-with-minimal-new-spending-tax-on-social-media-companies\/\"><span style=\"font-weight: 400;\">budget address<\/span><\/a><span style=\"font-weight: 400;\"> earlier this year. The data center tax incentives have been in place as part of bipartisan legislation signed by Pritzker during his first year in office.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">From 2020-24, there were 27 data centers that benefited by more than $983 million from these tax incentives, according to a <\/span><a href=\"https:\/\/dceo.illinois.gov\/content\/dam\/soi\/en\/web\/dceo\/aboutdceo\/reportsrequiredbystatute\/2024-data-centers-annual-report-submission.pdf\"><span style=\"font-weight: 400;\">state report<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0In his announcement, the governor cited growing impacts on energy affordability and water resources.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIllinois has an opportunity to continue leading in technological innovation and economic growth, but we also have a responsibility to protect working families and local communities as the data center industry rapidly expands,\u201d Pritzker said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cI am directing my administration to pause the processing of data center agreements while we continue working with the General Assembly and stakeholders on a comprehensive framework that protects affordability, safeguards our natural resources, and ensures responsible growth across Illinois.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The move comes after lawmakers failed to pass <\/span><a href=\"https:\/\/ilga.gov\/Legislation\/BillStatus?DocNum=5513&amp;GAID=18&amp;DocTypeID=HB&amp;LegId=167488&amp;SessionID=114\"><span style=\"font-weight: 400;\">House Bill 5513<\/span><\/a><span style=\"font-weight: 400;\">, known as the <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/power-act-data-center-regulation-wont-move-forward-this-spring\/\"><span style=\"font-weight: 400;\">POWER Act<\/span><\/a><span style=\"font-weight: 400;\">, by the spring session deadline on May 31, following months of committee conversations and advocacy from environmental groups.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bill would have required data centers to pay for and supply their own renewable energy, track and report water usage and enter community benefits agreements with the municipalities where they\u2019re based. After the bill failed to pass, lawmakers said negotiations would continue over the summer.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Advocates earlier lamented a &#8216;<\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/advocates-accusing-governor-of-lack-of-engagement-urge-passage-of-data-center-regulations-by-end-of-may\/\"><span style=\"font-weight: 400;\">lack of engagement<\/span><\/a><span style=\"font-weight: 400;\">&#8216; from Pritzker on supporting the bill.<\/span><\/p>\n<p><b>Read more: <\/b><a href=\"https:\/\/capitolnewsillinois.com\/news\/power-act-data-center-regulation-wont-move-forward-this-spring\/\"><b>POWER Act data center regulation won\u2019t move forward this spring<\/b><\/a><b> | <\/b><a href=\"https:\/\/capitolnewsillinois.com\/news\/glock-ban-prescription-drug-board-among-measures-that-stall-in-final-days\/\"><b>Glock ban, prescription drug board among measures that stall in final days<\/b><\/a><\/p>\n<p><span style=\"font-weight: 400;\">When it was clear the bill wouldn\u2019t be ready for prime time by the spring deadline, lawmakers from both chambers sent a letter to Pritzker calling for a tax credit pause.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe believe the responsible course of action is to pause the data center tax credits and exemptions in the FY 2027 budget until common-sense guardrails are in place,\u201d they wrote in the letter, obtained by Capitol News Illinois. \u201cIt is not only fiscally irresponsible, but also unconscionable to continue to provide millions of taxpayer dollars to Big Tech corporations harming our climate, straining our grid, and making electric bills unaffordable for working families.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, House Speaker Emanuel \u201cChris\u201d Welch, D-Hillside, told Capitol News Illinois earlier this week that the pause on data center credits did not have the support of the Democratic caucus to get through session, saying \u201cnot only did it struggle, it wasn\u2019t even close.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cNow, let\u2019s be clear, we certainly hear people\u2019s concerns about data centers. We\u2019ve had numerous hearings about them. I represent parts of DuPage County, so I hear those conversations about noise, water consumption, and energy costs,\u201d Welch said. \u201cI know how hard our friends in the environmental energy space are working on this very topic. They\u2019re complex issues that just don\u2019t get done right away.\u201d<\/span><\/p>\n<p><b>Resource strain<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Data centers have already put a major strain on energy infrastructure, driving up demand and prices for regular customers \u2014 and many more are seeking access to Illinois\u2019 grid.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Actual and projected demand from the data centers raised costs by <\/span><a href=\"https:\/\/www.eenews.net\/articles\/data-centers-drive-76-surge-in-pjm-power-prices\/\"><span style=\"font-weight: 400;\">$13 billion<\/span><\/a><span style=\"font-weight: 400;\"> over the past two energy auctions on the PJM interconnection, an electric grid that provides energy to 13 states, including northern Illinois.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A February report from the Union of Concerned Scientists found those costs could increase by <\/span><a href=\"https:\/\/www.nprillinois.org\/illinois\/2026-02-10\/report-shows-data-centers-could-significantly-add-to-electricity-cost-in-illinois\"><span style=\"font-weight: 400;\">another $37 billion<\/span><\/a><span style=\"font-weight: 400;\"> in Illinois alone over the next 25 years.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Those rising supply costs have added an average of $12 per month to residential customers\u2019 bill over the last four years, according to ComEd CEO Gil Quiniones. It would have been even higher, around $16 per month, absent <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/high-energy-prices-federal-dollars-turn-nuke-subsidies-into-ratepayer-relief-in-northern-illinois\/\"><span style=\"font-weight: 400;\">ratepayer relief<\/span><\/a><span style=\"font-weight: 400;\"> built into the state\u2019s 2021 landmark climate bill.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ComEd, which receives energy from the PJM grid, has nearly 100 data center requests in its pipeline. If all were to come to fruition, they would draw more than 30,000 megawatts \u2014 nearly 1.3 times higher than ComEd\u2019s historic peak rate of less than 24,000 megawatts in July 2011.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The requests from data centers seeking to access the grid in ComEd\u2019s service territory are increasingly larger in size and scale.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cReally, it used to be the average size of data center applications are in the 150- to 200-megawatt range,\u201d Quiniones said. \u201cNow it\u2019s 700- to 750-megawatt range. It\u2019s because of those big training data centers.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The huge surge in demand by data centers, which ComEd said has accelerated at an \u201cexponential pace\u201d since 2019, comes at a time when the state is facing <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/as-state-regulators-warn-of-impending-energy-shortfalls-capacity-prices-rise-again\/\"><span style=\"font-weight: 400;\">projected energy shortfalls<\/span><\/a><span style=\"font-weight: 400;\"> that are expected to drive up energy costs if not resolved.<\/span><\/p>\n<p><b>Labor calls for \u2018pause on pause\u2019<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Organizers from Climate Jobs Illinois and the Illinois AFL-CIO called Pritzker\u2019s tax credit pause \u201cshortsighted\u201d and called on him to \u201cpause his pause.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The tax incentive legislation required data center owners and operators to require their contractors to enter into approved project labor agreements to qualify for the benefits.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a joint statement, the labor leaders accused Pritzker of issuing an order \u201cto generate headlines, rather than practical results.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis pause does nothing to lower utility bills, protect the grid, or advance clean energy,\u201d they wrote. \u201cInstead, it will send billions of dollars in investment and thousands of union jobs to Indiana, Kentucky, and Ohio \u2014 states that sit on the same electrical grid, where those data centers will be built anyway, just without Illinois workers protected by nationally leading labor standards and without the clean energy requirements we&#8217;ve collaboratively fought to establish here.\u201d<\/span><\/p>\n<p><b>Other legislative proposals<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In addition to ordering a pause on the tax incentives for data centers, the governor proposed <\/span><a href=\"https:\/\/gov-pritzker-newsroom.prezly.com\/gov-pritzker-pauses-new-data-center-tax-incentives?utm_source=prezly.com&amp;utm_medium=campaign&amp;utm_campaign=Gov.+Pritzker+Pauses+New+Data+Center+Tax+Incentives&amp;utm_id=a9fc8d83-ccff-4913-8362-0c28ccf80b79&amp;utm_content=story+title\"><span style=\"font-weight: 400;\">six other principles<\/span><\/a><span style=\"font-weight: 400;\"> for reform.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pritzker urged lawmakers to work with consumer advocates, labor organizations and environmental stakeholders to pass legislation in the veto session that would: require data centers to pay for the costs of their energy and water demand, require them to support the generation of new renewable energy, to track and report water use, to adhere to air quality standards and to enter agreements with the communities that host them.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He also advocated for legislation that would allow utilities to prioritize power to residential and regular business customers in times of high energy demand.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cData centers should temporarily go dark when the grid is strained to ensure reliable electric service for Illinoisans,\u201d the proposal said. \u201cData centers that don&#8217;t supply their own clean energy could have their electric service interrupted when the grid is strained so Illinoisans\u2019 lights stay on.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ComEd CEO Quiniones told Capitol News Illinois in a recent interview that the utility also sees interruptible service for data centers as part of the solution to protecting energy affordability, along with more deployment of solar power and battery storage \u2014 both elements of a <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/pritzker-signs-major-energy-reform-bill-amid-projected-shortages\/\"><span style=\"font-weight: 400;\">major energy reform package<\/span><\/a><span style=\"font-weight: 400;\"> Pritzker signed at the start of this year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Consumer and environmental advocates applauded the governor\u2019s announcement and said they expected to continue conversations with lawmakers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abe Scarr, director of the Illinois Public Interest Research Group said \u201cthe devil is in the details\u201d but that the organization supported the \u201cdirection\u201d of the framework.
