His conviction for violating a local ordinance banning large-capacity magazines was recently overturned by the Washington, D.C., Court of Appeals on Second Amendment grounds.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But Attorney General Kwame Raoul\u2019s office responded Wednesday, arguing the 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> Circuit is not bound by decisions of the D.C. court \u2014 the equivalent of a state supreme court. It also described the Benson decision as an \u201coutlier that conflicts with every other appellate court to have addressed the issue.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At issue before the 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> Circuit is a constitutional challenge to the Protect Illinois Communities Act, or PICA, a sweeping ban on assault-style weapons and large-capacity magazines.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Illinois lawmakers passed that ban during a lame duck session in January 2023 following a mass shooting the previous summer at a Fourth of July parade in Highland Park that left seven people dead and dozens more injured or traumatized.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The convicted gunman in that shooting used a Smith &amp; Wesson M&amp;P15 semiautomatic rifle and multiple 30-round magazines.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In November 2024, a federal judge in East St. Louis sided with gun rights advocates and the gun industry and <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/federal-judge-strikes-down-illinois-assault-weapons-ban-setting-up-likely-appeal\/\"><span style=\"font-weight: 400;\">struck down<\/span><\/a><span style=\"font-weight: 400;\"> the Illinois law as unconstitutional. The state has appealed that decision to the 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> Circuit, which heard <\/span><a href=\"https:\/\/news.bloomberglaw.com\/litigation\/illinois-assault-weapons-ban-faces-high-stakes-appellate-test\"><span style=\"font-weight: 400;\">oral arguments<\/span><\/a><span style=\"font-weight: 400;\"> in September but has not yet rendered a decision. The law <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/appeals-court-keeps-illinois-assault-weapons-ban-in-place\/\"><span style=\"font-weight: 400;\">remains in effect<\/span><\/a><span style=\"font-weight: 400;\"> while the appeal is pending.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many legal observers say the case is likely to end up before the U.S. Supreme Court, which has never issued a definitive ruling on assault weapons bans. The court did, however, <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/us-supreme-court-wont-hear-challenge-to-illinois-assault-weapons-ban-for-now\/\"><span style=\"font-weight: 400;\">deny requests<\/span><\/a><span style=\"font-weight: 400;\"> to issue preliminary injunctions blocking the law from being enforced while legal challenges proceeded.<\/span><\/p>\n<p><b>Shifting standards<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In other Second Amendment cases in recent years, the court has taken a more expansive view of the right to bear arms and has been broadly skeptical of state and local laws that seek to limit that right.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2008, the court ruled in <\/span><a href=\"https:\/\/www.law.cornell.edu\/supct\/pdf\/07-290P.ZO\"><span style=\"font-weight: 400;\">District of Columbia v. Heller<\/span><\/a><span style=\"font-weight: 400;\"> that the Second Amendment protects an individual\u2019s right to bear arms, as opposed to a collective societal right to maintain a militia. In striking down an ordinance banning the possession of handguns in the district, the court also said the Second Amendment protection extends to \u201call instruments that constitute bearable arms, even those that were not in existence at the time of the founding.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">More recently, in 2022\u2019s <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\"><span style=\"font-weight: 400;\">New York State Rifle &amp; Pistol Association v. Bruen<\/span><\/a><span style=\"font-weight: 400;\"> decision, the court went further by saying the Second Amendment gives all Americans the right to bear \u201ccommonly used\u201d arms in public. It also said that to pass constitutional muster, a law limiting the right to bear arms had to be \u201cconsistent with the Nation\u2019s historical tradition of firearm regulation.\u201d<\/span><\/p>\n<p><b>Benson decision<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In the case of Tyree Benson, the Washington, D.C., court ruled 2-1 that magazines of any capacity are \u201carms\u201d covered by the Second Amendment. It also said large-capacity magazines in particular \u201care ubiquitous in our country, numbering in the hundreds of millions, accounting for about half of the magazines in the hands of our citizenry, and they come standard with the most popular firearms sold in America today.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Erin Murphy, an attorney for a firm representing several plaintiffs in the Illinois case, argued in the memo that the popularity of large-capacity magazines put them in the same category as handguns, which the Supreme Court said in the Heller decision could not be banned.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But Assistant Attorney General Megan Brown argued in a reply memo that relying on the popularity of a particular weapon or device to determine whether it\u2019s constitutionally protected represented a kind of circular logic that the 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> Circuit rejected when it denied a motion to block enforcement of the assault weapons ban in 2023.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> Circuit has not indicated when it intends to issue a decision.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/capitolnewsillinois.com\/\"><i><span style=\"font-weight: 400;\">Capitol News Illinois<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">\u00a0is a nonprofit, nonpartisan news service that distributes state government coverage to hundreds of news outlets statewide.
