(Capitol News Illinois photo by Andrew Adams) <\/em><\/p>\n<p>By HANNAH MEISEL<br \/>Capitol News Illinois<br \/><a href=\"mailto:hmeisel@capitolnewsillinois.com\">hmeisel@capitolnewsillinois.com<\/a><\/p>\n<p>CHICAGO \u2013 For nearly three months, government lawyers in former Illinois House Speaker Michael Madigan\u2019s federal corruption trial have tried to drill home the amount of control the longtime Democratic powerbroker wielded in Springfield.<\/p>\n<p>Whether or not the jury is convinced that Madigan held all the cards during his record 36 years as House speaker, the career politician on Monday found himself in a position with no control: on the witness stand for cross-examination by the lead prosecutor in his case.<\/p>\n<p>Assistant U.S. Attorney Amarjeet Bhachu, who\u2019s spent nearly half of his two-decade career as a prosecutor with Madigan in his crosshairs, wasted no time confronting the former speaker with a wiretapped phone call that had been barred from trial until last week.<\/p>\n<p><strong>Read more:<\/strong> <a href=\"https:\/\/capitolnewsillinois.com\/news\/jurors-to-hear-tape-of-madigan-saying-comed-contractors-made-out-like-bandits\/\">Jurors to hear tape of Madigan saying ComEd contractors \u2018made out like bandits\u2019<\/a><\/p>\n<p>\u201cThat\u2019s you laughing there, isn\u2019t it, sir?\u201d Bhachu asked Madigan after playing a clip from an August 2018 call between Madigan and longtime Statehouse lobbyist Mike McClain. The pair are co-defendants in the trial, with Madigan facing 23 bribery or other public corruption counts and McClain facing six.<\/p>\n<p>In the call, Madigan jokes to McClain that certain contractors for electric utility Commonwealth Edison \u201chave made out like bandits.\u201d<\/p>\n<p>\u201cOh my God,\u201d McClain agreed. \u201cFor very little work too.<\/p>\n<p>While the pair had referenced a labor leader earlier in the call, it\u2019s unclear what other contractors they were referencing. On Monday, prosecutors didn\u2019t insinuate any of the individuals referenced in the call were part of Madigan and McClain\u2019s alleged bribery scheme aimed at ComEd.&nbsp;<\/p>\n<p>But Bhachu contrasted the acknowledgement with Madigan\u2019s own claim last week that he was \u201cvery angry\u201d to learn from prosecutors that his allies hadn\u2019t worked for their checks from ComEd, which in one instance dated back to 2011.&nbsp;<\/p>\n<p><strong>Read more:<\/strong> <a href=\"https:\/\/capitolnewsillinois.com\/news\/they-were-being-paid-as-a-favor-to-mike-madigan-feds-star-witness-takes-stand\/\">\u2018They were being paid as a favor to Mike Madigan\u2019: Feds\u2019 star witness takes stand<\/a> | <a href=\"https:\/\/capitolnewsillinois.com\/news\/comed-lobbyist-warned-fbi-mole-to-keep-madigan-happy-and-not-mess-with-no-work-contracts\/\">ComEd lobbyist warned FBI mole to \u2018keep Madigan happy\u2019 and not mess with no-work contracts<\/a><\/p>\n<p>He also claimed he knew nothing of the no-work contracts until details of the feds\u2019 investigation began to surface publicly in 2019 \u2013 a detail that U.S. District Judge John Blakey last week cited as reason to reverse his pretrial decision to block prosecutors from playing the call.<\/p>\n<p>\u201cMr. Madigan, before you began testifying last week, sir, you took an oath, didn\u2019t you?\u201d Bhachu asked, kicking off more than three hours of questioning Monday afternoon.<\/p>\n<p>\u201cYes I did,\u201d Madigan replied.<\/p>\n<p>\u201cAnd you knew that oath required you to tell the whole truth, not just part of it, sir?\u201d Bhachu asked, more of a statement than a question.<\/p>\n<p>\u201cYes,\u201d Madigan said.<\/p>\n<p><strong>Bhachu v. Madigan<\/strong><\/p>\n<p>Bhachu\u2019s face-off with Madigan seemed an unlikely prospect throughout trial; McClain formally waived his right to testify in his own defense shortly before the holiday break last month.&nbsp;<\/p>\n<p>Madigan\u2019s decision to testify \u2013 foretold only by an increase in family members present in the courtroom Tuesday morning \u2013 was a stunning turn of events for a trial that seemed to be winding down.<\/p>\n<p><strong>Read more:<\/strong> <a href=\"https:\/\/capitolnewsillinois.com\/news\/madigan-testifies-in-own-defense\/\">Madigan takes witness stand, denying he traded \u2018public office\u2019 for \u2018private gain\u2019<\/a> | <a href=\"https:\/\/capitolnewsillinois.com\/news\/breaking-madigan-to-take-witness-stand-in-his-corruption-trial\/\">Madigan to take witness stand in his corruption trial<\/a><\/p>\n<p>The famously reserved Madigan spent hours under questioning from his attorney Dan Collins last week. The pair sought to paint a picture of a five-decade career in politics and law marked by \u201chard work and discipline,\u201d a tough upbringing, and a devotion to the family he created with a single mother he met as a young legislator.<\/p>\n<p>He butted heads with McClain\u2019s attorney only a few times during a short cross-examination last week, which mostly allowed the former speaker to further deny knowing the details of tasks he delegated to McClain.&nbsp;<\/p>\n<p>Throughout decades of friendship dating back to the 1970s when they served together in the Illinois House, Madigan came to rely on McClain and would often ask the successful lobbyist to find job opportunities for the many people who asked the speaker for help.<\/p>\n<p>That was the case for the five political allies who received no-work contracts with ComEd, along with many other examples included in trial and outside of it, Madigan testified.<\/p>\n<p>But Bhachu on Monday had little patience for the former speaker\u2019s sometimes lengthy explanations, often chiding Madigan for not answering the question he\u2019d asked.&nbsp;<\/p>\n<p>The courtroom, packed with so many onlookers that court officials opened a second overflow room with a video feed, watched as Bhachu questioned Madigan about his efforts to help find employment for the son of longtime Democratic U.S. Rep. Bobby Rush.<\/p>\n<p>In 2008, Jeffrey Rush was sentenced to six months in state custody for having sexual relationships with female inmates while working as a security supervisor at a halfway house run by the Illinois Department of Corrections. The jury was not told of Rush\u2019s guilty plea or jail time but was told of his firing from IDOC for what Madigan characterized as \u201ca big mistake.\u201d<\/p>\n<p>\u201cThis is a guy I\u2019m gonna wanna help somewhere along the road,\u201d Madigan said of Rush in another wiretapped call in August 2018, a little over a decade after his sentencing.<\/p>\n<p>The former speaker said Congressman Rush had recently told him about his son\u2019s past and asked if he could help. Madigan asked for his resume and then passed it along to McClain, he testified.<\/p>\n<p>\u201cYou knew he\u2019d abused his position of public trust?\u201d Bhachu asked of Rush\u2019s taxpayer-funded job with the state prison system.<\/p>\n<p>\u201cTen years prior,\u201d Madigan replied, going on to say that he was interested in how Rush was \u201ctrying to rehabilitate himself,\u201d noting he\u2019d spent five years doing community outreach for a church on Chicago\u2019s South Side.<\/p>\n<p>McClain never found a job for Rush, even after asking a ComEd official about him months later in a phone call jurors heard earlier in trial. But in a newly introduced exhibit Monday, Bhachu showed Rush\u2019s temporary $20-per-hour consultant contracts with one of Madigan\u2019s campaign funds for the fall of 2018 into the beginning of 2019. The former speaker testified that Rush worked on legislative campaigns that election cycle.<\/p>\n<p><strong>Imbalance of loyalty<\/strong><\/p>\n<p>Bhachu also used the Rush episode in an attempt to combat Madigan\u2019s efforts at distancing himself from McClain.<\/p>\n<p>\u201cYou trusted Mr. McClain with sensitive matters, didn\u2019t you sir?\u201d Bhachu asked.<\/p>\n<p>\u201cSometimes,\u201d Madigan answered.<\/p>\n<p>\u201cThis is a sensitive matter here, isn\u2019t it, sir?\u201d Bhachu asked.<\/p>\n<p>\u201cSensitive in the fact that he\u2019d made a mistake,\u201d Madigan replied.<\/p>\n<p>Minutes earlier, Bhachu showed the jury a letter already published earlier in trial, in which McClain told Madigan of his impending retirement from lobbying in December 2016. McClain wrote that he \u201cwanted to let my real client know\u201d \u2013 a phrase Madigan acknowledged he\u2019d heard his friend use about him in the past.<\/p>\n<p>The effusive letter also promised that \u201cAt the end of the day I am at the bridge with my musket standing with and for the Madigan family\u201d and that he\u2019d \u201cnever leave\u201d the former speaker\u2019s side.<\/p>\n<p>\u201cYou knew Mr. McClain was loyal to you,\u201d Bhachu asked.<\/p>\n<p>\u201cYes I did,\u201d Madigan answered.<\/p>\n<p>\u201cWere you loyal to him?\u201d Bhachu asked?<\/p>\n<p>\u201cWell I don\u2019t think I was as loyal to him as he was to me,\u201d the former speaker replied.<\/p>\n<p>After more back and forth, Madigan landed on a definition of loyalty as \u201cI viewed him as a friend and I wouldn\u2019t do anything to hurt him,\u201d but insisted that he didn\u2019t always follow McClain\u2019s advice.<\/p>\n<p>\u201cThat\u2019s not what I asked,\u201d Bhachu said.<\/p>\n<p>Madigan also claimed he could not recall a time when he reciprocated McClain\u2019s expressions of loyalty.<\/p>\n<p>During the exchange, McClain sat stone-faced at his own defense table at the far side of the courtroom.<\/p>\n<p>Earlier in the day, one of McClain\u2019s attorneys asked to renew a previously denied motion for severance from Madigan in trial. Last summer, McClain\u2019s defense team predicted that Madigan would try to throw him under the bus and McClain would \u201cbe in effect prosecuted by ambush.\u201d<\/p>\n<p><strong>\u2018A big red flag\u2019<\/strong><\/p>\n<p>In addition to the \u201cmade out like bandits\u201d wiretap, the feds last week won the right to introduce two more bits of evidence: a handful of short segments from a 2009 videotaped interview with Madigan reflecting on Chicago\u2019s old patronage system and a deposition he gave in September 2018.&nbsp;<\/p>\n<p>The former was given as part of an oral history project about longtime Chicago Mayor Richard J. Daley, while the latter was taken as part of a federal lawsuit filed by an unsuccessful challenger to Madigan\u2019s Illinois House seat in the 2016 Democratic primary election.<\/p>\n<p>Bhachu contrasted Madigan\u2019s matter-of-fact comments about the patronage system being a way to beef up the Democratic Party\u2019s army of volunteers \u2013 and the fact that, at least in 2009, he viewed it as \u201ccreeping into its grave\u201d but not quite dead \u2013 with his sworn deposition nearly a decade later.<\/p>\n<p>In that deposition, Madigan said his test for hiring someone was that they be \u201chonest, hardworking people with integrity.\u201d<\/p>\n<p>\u201cWould you agree with me, sir, that somebody who abuses their position of public trust by getting involved sexually with an inmate, that\u2019s not a person of integrity?\u201d Bhachu asked, referring again to Jeffrey Rush.<\/p>\n<p>\u201cAt that time, yes,\u201d Madigan replied, reiterating that Rush had been fired from IDOC more than a decade before he hired him.<\/p>\n<p>Bhachu also took Madigan through a series of wiretapped phone conversations he\u2019d had with then-Chicago Ald. Danny Solis in 2017 and 2018, beginning a year into Solis\u2019 cooperation with the FBI.<\/p>\n<p>Madigan and Collins had attempted to recontextualize some of those exchanges last week, with Madigan saying he had \u201ca great deal of surprise and concern\u201d during a June 2017 phone call in which Solis explicitly mentioned a \u201cquid pro quo.\u201d&nbsp;<\/p>\n<p><strong>Read more:<\/strong> <a href=\"https:\/\/capitolnewsillinois.com\/news\/you-shouldnt-be-talking-like-that-madigan-scolded-alderman-turned-fbi-mole-for-bringing-up-quid-pro-quo\/\">\u2018You shouldn\u2019t be talking like that\u2019: Madigan scolded alderman-turned-FBI mole for bringing up \u2018quid pro quo\u2019<\/a><\/p>\n<p>The speaker had asked Solis, then the chair of Chicago City Council\u2019s powerful zoning committee, to introduce him to a real estate developer behind a proposed apartment complex project in the city\u2019s booming West Loop neighborhood. At the direction of the FBI, Solis arranged for the meeting, but first falsely told Madigan that his approvals of the zoning changes necessary for the project would be predicated on the developer contracting with the speaker\u2019s property tax appeals law firm.<\/p>\n<p>\u201cThis was a big red flag for you, right? That\u2019s why you had a great deal of concern?\u201d Bhachu asked.<\/p>\n<p>Madigan last week testified that he\u2019d continued thinking about Solis\u2019 words in the weeks before a meeting was set up and decided to confront the alderman there. In a secretly recorded video the jury saw in November \u2013 and again on Monday \u2013 the speaker pulled Solis aside for a private conversation before the meeting with the developer, telling him: \u201cYou shouldn\u2019t be talking like that.\u201d<\/p>\n<p>According to Madigan, Solis\u2019 facial expression after the brief scolding told him \u201che got the message.\u201d<\/p>\n<p>But Bhachu took the former speaker through five more exchanges with Solis from 2017 and 2018 in which Bhachu said the alderman was \u201cagain suggesting something inappropriate.\u201d Often in those recordings, Bhachu pointed out, Madigan responded with seemingly agreeable phrases like \u201cokay, very good.\u201d<\/p>\n<p>While Madigan insisted that he was trying to dodge Solis\u2019 questions by answering in that way, Bhachu asked why the former speaker still agreed to forward Solis\u2019 name to newly elected Gov. JB Pritzker in the fall of 2018 for a lucrative appointment to a state board.<\/p>\n<p>\u201cIn spite of all those statements, you were prepared to actually recommend him for a board position, right?\u201d Bhachu asked.<\/p>\n<p>\u201cI was prepared to entertain the possibility I would submit his name,\u201d Madigan replied.<\/p>\n<p>Previous testimony from the former speaker\u2019s chief of staff at the time and former Pritzker staffer-turned-congresswoman Nikki Budzinski indicated the recommendation was never made before Solis\u2019 cooperating witness cover was blown in January 2019.<\/p>\n<p>Madigan will be back on the stand for further cross-examination on Tuesday.<\/p>\n<p><em><a href=\"https:\/\/capitolnewsillinois.com\/\">Capitol News Illinois<\/a> is a nonprofit, nonpartisan news service that distributes state government coverage to hundreds of news outlets statewide.
