Governor Files for Bailey Lawsuit to be Moved to Federal Court

The Illinois Attorney General's office has filed a request that the lawsuit filed against Governor J.B. Pritzker by St. Rep. Darren Bailey be transferred to Federal Court. That would mean no hearing would be held as scheduled Friday in Clay County Circuit Court in Louisville. 

Bailey is attempting to seek an emergency ruling that would keep the case in Circuit Court. The hearing is still on the calendar for 1pm Friday in Louisville.

The Attorney General's Office had earlier sought to have the case moved to another circuit court, but that request was denied by Circuit Judge Michael McHaney. McHaney is also the judge who ruled for Bailey and against the governor in an earlier matter. 

In this latest effort, the Attorney General's Office is arguing that since Bailey alleged that his civil rights were being violated by the governor's executive orders, the matter should be considered in Federal court. In the original hearing on the matter in Louisville, Judge McHaney granted Bailey a temporary restraining order against having to comply with the governor's order. Bailey later asked that the TRO be dismissed.
