Traffic Citation Dismissed from Fatal Crash

Prosecutors have decided not to prosecute a traffic citation issued in a fatal collision in Effingham about a year ago.

35-year-old Nick Bumgarner of Mattoon had been cited for failure to yield after turning in front of a motorcycle operated by 19-year-old Michael Williams of Effingham. The cycle struck Bumgarner's delivery truck, resulting in Williams' death. The crash occurred just before 6pm last October 27 east of the intersection of Althoff Drive and Willenborg Street.

Effingham County State's Attorney Bryan Kibler Monday said he decided not to prosecute the citation after reviewing expert opinions as to the speed of the motorcycle at the time of the crash as well as whether the headlight on the motorcycle was being used.
