Motion to Reconsider Miller's Sentence Denied

Judge Kimberly Koester Wednesday denied a defense motion to reconsider the sentence of Jay C. Miller of Altamont.

Miller was sentenced to 17 years in prison after being found guilty of drug induced homicide and delivery of controlled substance. Prosecutors contend that Miller made available the heroin that resulted in the death of Jessica James of Effingham earlier this year.

Public Defender Scott Schmidt, who represents Miller, asked Judge Koester to reconsider the sentence she imposed July 31, while Special State's Attorney Ralph Fowler argued against the motion.

Miller's case on counts of aggravated intimidation and aggravated battery was also in court Wednesday.  The charges stem from an alleged attack by Miller on a fellow jail inmate. A trial date was set for October 6, with a pre-trial hearing on September 18.
